Our training and certification programs are intended solely for professional development purposes and do not constitute legal advice, licensure preparation, or governmental certification. While we strive to maintain current and accurate content, it is ultimately the responsibility of the student to stay informed and updated on the ever-changing rules, regulations, and guidelines. NAMU® shall not be liable for outdated materials or any actions taken based on such content.
10. 3rd-party Online Proctoring - indemnify/HOLD HARMLESS:
NAMU® utilizes a third-party service provider to deliver online test proctoring services as part of our certification programs. By participating in any program that includes a proctored exam, the student acknowledges and accepts that the proctoring service may be subcontracted to an independent provider.
NAMU® makes no representations or warranties, express or implied, regarding the availability, accuracy, reliability, or performance of any third-party proctoring service. The student agree that the use of such services is at the student’s own risk and subject to the terms, policies, and privacy practices of the third-party provider.
To the fullest extent permitted by law, the student agrees to release, indemnify, and hold harmless NAMU®, its officers, directors, employees, agents, affiliates, and licensors from any and all claims, damages, liabilities, losses, or expenses — including, without limitation, legal fees and costs — arising out of or related to the student’s use of or reliance on the online test proctoring service, including but not limited to:
Technical difficulties or service outages
Disputes related to test conduct, results, privacy concerns or security
Alleged breaches of privacy or data protection
Any action or inaction of the third-party proctoring provider
NAMU® does not control and is not responsible for the content, conduct, or policies of third-party vendors. It is the student’s responsibility to ensure that the student’s computer, software, and testing environment meet the technical requirements and conduct standards outlined by the proctoring provider.
The student’s continued use of this site and participation in any proctored program signifies the student’s acceptance of these terms.
11. Testimonial Disclaimer
Testimonials presented on the NAMU® website are submitted in various formats and reflect the individual experiences of those who have used our services and programs. While many testimonials represent positive results, such results are not guaranteed or necessarily typical. Outcomes may vary depending on individual circumstances, background, effort, and market conditions. Some individuals providing testimonials may have received free access or discounts in exchange for their submissions. The testimonials are posted verbatim except for grammar corrections or where they are shortened for clarity and conciseness. NAMU® does not verify every claim made in these testimonials and does not accept liability for their accuracy. The opinions and comments expressed are those of the individuals and do not necessarily reflect NAMU®’s views or policies.
12. Use of Certification Title and Branding
While students may reference their NAMU® certification designation on resumes, professional bios, and platforms such as LinkedIn, the use of the NAMU® logo or full brand name on business cards, promotional materials, websites, or advertisements is prohibited without explicit written authorization. Students may list the full name and acronym of their certification (e.g., Certified Master Mortgage Underwriter - NAMU®-CMMU®) within a certification section of professional profiles or signatures, provided that such reference does not misrepresent affiliation or imply licensure or governmental endorsement. Any misuse of the NAMU® brand may result in revocation of certification privileges.
13. Certification Disclaimer
NAMU® certification is intended exclusively for professional development purposes and is not a state or federally issued license or credential. Participation in NAMU® programs does not indicate government affiliation or recognition by regulatory bodies such as HUD, FHA, or VA. Passing a certification exam indicates that the student has completed coursework and successfully passed a timed, online proctored assessment. It does not imply legal authority to practice, nor does it guarantee employment, job placement, or business outcomes. NAMU® reserves the right to update curriculum or discontinue certifications at its sole discretion.
14. Directory Listing & Privacy Notice
By submitting your name and profile image for inclusion in the password protected NAMU® Certificant Directory, you expressly consent to have such information published and made publicly accessible on NAMU®’s platforms. This may include visibility by external users through search engines and direct links. You agree to hold harmless and indemnify NAMU®, its affiliates, directors, officers, employees, and agents from any claims or liabilities resulting from the publication of such content. You may request removal at any time by contacting our administrative office, and NAMU® will respond to such requests within a commercially reasonable timeframe.
15. Exam Retake Policy
NAMU® allows each student up to three (3) attempts to pass any certification exam. Between each failed attempt, the student must observe a fourteen (14) calendar day waiting period. If all three attempts result in failure, the student must wait a full year from the date of the third attempt before re-registering for the same certification. This policy is designed to preserve the integrity and standard of our programs while giving candidates ample time to review the material. Students are encouraged to prepare thoroughly before scheduling each attempt.
16. ADA Accessibility Commitment
NAMU® is dedicated to ensuring digital accessibility for all users, including individuals with disabilities. Our website and training platforms aim to conform with WCAG 2.0 Level AA standards, and we continually review and enhance our services to improve usability. All training videos feature closed captioning, and extended time is available for certification exams upon documented request. 17. Advertising and Endorsements
NAMU® may accept paid advertising from external parties under strict guidelines. Advertisements do not imply endorsement, approval, or recommendation of the products or services shown. NAMU® does not accept ads promoting illegal activities, firearms, gambling, pornography, alcohol, tobacco, or content deemed discriminatory or offensive. All advertisements must comply with applicable local, state, and federal laws. NAMU® reserves the right to reject, remove, or modify any advertisement at any time without notice, particularly if it is deemed in conflict with NAMU®’s mission or brand integrity.
18. Limitation of Liability
NAMU® provides its services, programs, and website content "as is" without warranties of any kind. To the fullest extent permitted by law, NAMU® disclaims all warranties, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. Under no circumstances shall NAMU®, its officers, directors, employees, or affiliates be liable for any indirect, incidental, consequential, special, or exemplary damages arising from your use of the site, certification programs, or third-party tools. You expressly agree that your participation is voluntary and at your sole risk.
19. Governing Law and Jurisdiction
This Terms of Use Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising under or in connection with these terms shall be resolved exclusively in the state courts located in Broward County, Florida. By using this website and NAMU®’s services, you irrevocably consent to the jurisdiction and venue of such courts and waive any objection based on inconvenient forum or lack of jurisdiction.
20. Entire Agreement and Modification
These Terms of Use constitute the complete agreement between you and NAMU® regarding use of the site and participation in its programs and supersede any prior or contemporaneous communications. NAMU® reserves the right to update, revise, or replace these Terms of Use at any time. Such changes will be effective immediately upon posting. Continued use of NAMU®’s services after any modifications constitutes acceptance of those changes. A printed copy of these terms and any notices provided electronically shall be admissible in any legal proceedings relating to this agreement.
21. Force Majeure
Notwithstanding any other term or condition of the Terms of Use, NAMU® shall not be obligated to perform or observe its obligations undertaken in the Terms of Use if prevented or hindered from doing so by circumstances beyond its control.
22. Section Headings

25. No Job Placement Provided
NAMU® does not provide job placement assistance of any kind. Students who enroll in our certification programs should understand that, while our courses are designed to enhance professional knowledge and career preparedness, we do not guarantee employment or facilitate job matching services. Employment outcomes depend on a variety of external factors beyond NAMU®’s control, including but not limited to job market conditions, geographic location, individual experience, professionalism, communication skills, and the ability to network and interview effectively. As such, completion of a NAMU® certification should be viewed as one component of broader career development efforts, and not as a direct path to employment
